ok.. im sorry everyone, but I need to vent..   I am so angry right now..

My Mother and Father got a collection notice in the mail.  now, they didnt get anything else on this until this notice.  it is for a large amount of money.  they called on it and apparently it is something to do with a traffic incident.  the person they spoke with said that
they have the police report.. now.. get this.. they say the person with the claim (we will call this person Richard Cranium)  got into an accident John Doe (name changed just incase, but is is a very um.. common name) on Sept 14th.  That my father loaned John Doe their van.  ok.. so, my dad has a friend named John Doe.. but the drivers license of the John Doe he knows doesnt match the John Doe's on the police report.    My Parents do NOT loan their van to anyone (but me) the van was not in the area (the other side of the state) on Sept 14.   And get this.  apparently John Doe didnt have insurance or registration on my parents vehicle.  so what police person is going to just go.. oh... ok...  besides, where is the first place you would check for this info.. uh huh.. yeah.. its in there.. BUT, they had all the vans info.. plate #  Vin #..     And the report apparently wasnt signed by the officer that did it.. what the hell is that.. really?  I dont think that happens...

I think someone saw my mom and dads van when we WERE out there in Dec and said.. hey.. that van has a dent in it.. and copied down the plate #.   I think... no... I KNOW this is a bogus thing.. but how do you go about proving it..   I am just SO angry.. My parents are good people.. and I hate that someone is trying to take advantage of them.  I dont like it when ANY good person gets taken advantage of.  and I am a fixer.. I need to make it better and there is nothing I can do and that makes me even more angry.

My father is waiting on a copy of the police report and then is going to call the police dept.  I guess start there..   is it wrong of me to want the people/person that is doing this to get into a heep of trouble?  is it wrong of me to want them to suffer?

anyway... I just really needed to get that off my chest.... sadlly.. I dont feel any better..  Im still pissed.. really really pissed..

Its just wrong..... the Claim is bogus.. its an insurance fraud attempt.  or rather an fraud of attempt to collect.  I am pretty sure if they pull the business records of said company they will find they do not have a valid business lisence.  and that if You try to trace the calls on that it will likely go to residence.

This needs to be in the hands of the police and I hope that the persons attempting this are prosecuted with the fullest extent of the law.

Yes, Insurance Fraud is definitely on the rise, especially in this economy.

Your parents need to inform their own auto insurance company right away, so that a claim will be opened.  Since it involves an alleged automobile accident, their insurance will cover the claim.  The Insurance Company will investigate, and this sounds like a claim that their SIU (Special Investigations Unit) would be very interested in.  SIU departments usually work hand in hand with the local D.A., and love to see fraudulent claims prosecuted.  I have seen many like this, and unraveling them is usually pretty easy, although it takes time.  It is wonderful when the jackass gets sent away for Felony Insurance Fraud, I have played my part in doing so many times.  You will need to make sure that the adjuster understands that the claim needs to be fully investigated, some just want to pay the claim and get the file off of their desk.

It sounds like this first notice is for repairs to 'other' vehicle, since it was sent fairly recently.  Be on the alert for the Personal Injury lawsuit that will probably follow in 4 to 6 months, that will be filed by the people who were allegedly in the 'other' vehicle.  Sorry to be seeming to be adding more worry to you, but, I make my living defending people like your parents, and have seen this happen more times than I can count.  Be confident, Lilac, these things do work out, but it takes a long time.  I always tell my clients that 'it' is my problem now, and to not think of the claim anymore.

thank you to all that posted.. Leda.. I have passed on your message. turns out the car on the police report isnt even a van.  the officer said he got the # right off the plate, so there is still a slight problem there.. can a state accidently issue 2 plates with the same #?

kiah.. hon.. you are the sweetest thing ever.. ya know.. you made me think.. compared to with what others are going though.. this is cake.  Hell, it doesnt even involve me directly.. and I didnt mean to sound all... Me Me Me, if I came off that way I am sorry.. I just was hoping that by getting it out, I could shut it off.. and well, it didnt work..  so Im sorry..

Don't be sorry, you need to vent at times and believe me it does help.  And it helps to know you have friends who are willing to help and maybe at times think of things that you don't.  That is the reason you have friends that you feel comfortable with venting on. 

Hopefully all does work out ok for your parents, no one should have to go thru that kind of headache.

ive heard of accidents like this. where the plate was stolen. that could be a possibility.

Plates do get stolen and some people don't realize their plate is missing for awhile. When the officer ran the plate number he should have figured out that it didn't match the vehicle.

Sounds like things will resolve fairly easily, Lilac.  The officer may have just written the license number down wrong, that happens.

It could be there was a duplicate plate.   State plate processing sometimes messes up.. the issuing county should have caught it though.   when it was entered into the computer at the Tag Office when you pay you car tag.. things should have been noted.  this is where it goes back to them pulling tag records on vehichle ID numbers.  to prove which vehichle the tag truly belongs to.  this is still possibly a fraud claim.. and the police as well as the insurance company investigator needs to be involved.  your parents interests have to be protected and Lilac.. you have a right to be angry.. They attack your parents its the same as an Attack on you.  at least thats how I feel about it.  I had a car dealership make it a point to try to seperate my parents when they were attempting to purchase a vehichle.. because they somehow felt my dad wasn't well enough to make decisions and they could pressure mom into accepting something that they didn't want.  my parents came home...I was so informed of this.... I made two phone calls... one to the chamber of commerce where i knew the owners wife worked.... and two to the dealership which i was handed off to the owner and the vice president  and I politely voiced my opinion on what took place. named the parties involved.. and Politely informed them that neither I.. nor any member of my family will do business with them again... and I would definately be announcing to members of my church and my community of their actions.  later that day i found out that my uncle was working for a dealership on the other side of the state... we called... talked to him.. he called back an hour later. said what all do you need on it and what color do you want....  that was sorted. by 6 pm that night he said i have someone on the way to go pick it up... can come you sign the papers tomorrow... mom got a new little nissan pickup truck.  the dealership that was screwing around... was trying to sell her a used ford ranger that had been wrecked previously.   Seniors are being taken advantage of left and right and we as the kids have to let them do their thing.. but at times we have to be the guard to potect them.  Hugs Lilac. your one hell of a strong lady

Many know I work in the insurance industry.  I do agree with Leda on calling your insurance company.  They will supply the legal team to defend the claim even if it's bogus.
